Terms of Service

These terms apply to services supplied by TM Architectural Designs Ltd ("we", "us", "our"), a company registered in England and Wales, through tmdesignsltd.com.
1. Our services
We prepare architectural drawings, structural calculations and building regulations packages remotely. We do not carry out site visits, structural surveys, or any building work.
2. Prices and payment
- Prices shown on our website are fixed fees in pounds sterling.
- Payment is taken in advance through Tide. Work begins once payment clears.
- Prices may change; the price confirmed to you in writing is the price that applies.
3. Information you provide
Our drawings are produced from the measurements, photographs and plans you supply. You are responsible for their accuracy.
We cannot verify dimensions remotely. Where measurements are wrong, incomplete or misleading, the drawings will reflect that, and correcting them may attract an additional fee. Our drawings carry a note recommending that measurements are re-checked on site and that the integrity of load-bearing elements is verified before work begins. That check is your responsibility or your builder's.
4. Turnaround
We aim to deliver within the turnaround stated for your service, measured from the date we receive both payment and all the information we need. Delays caused by incomplete information, or by requests for changes, extend that period. Turnaround times are targets, not contractual guarantees.
5. Revisions
Revisions to the agreed scope are included. Changes that alter the scope — a different design, additional storeys, or a new property — are new work and will be quoted separately.
6. Planning and building control outcomes
We prepare drawings to the standard required for submission. We cannot guarantee that any application will be approved. Decisions rest entirely with your local planning authority or building control body, and may turn on matters outside the drawings, including local policy and neighbour representations.
Where an application is refused for reasons attributable to our drawings, we will revise and resubmit at no further charge. This is your exclusive remedy in those circumstances.
7. Intellectual property
Copyright in all drawings and calculations remains with us. On full payment you receive a non-exclusive licence to use them for the specific project they were prepared for, including submission to authorities and issue to your contractor. You may not resell them, or reuse them on a different property, without our written consent.
8. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that:
- Our total liability arising from any project is limited to the fees you paid us for that project.
- We are not liable for indirect or consequential loss, loss of profit, loss of opportunity, construction delay costs, or the cost of building work carried out in reliance on drawings that were based on inaccurate information supplied to us.
- We are not liable for the acts or omissions of your builder, contractor or any other third party.
We recommend you satisfy yourself that this allocation of risk is acceptable, and insure accordingly, before instructing us.
9. Cancellation and consumer rights
If you are a consumer, you normally have 14 days to cancel a distance contract. Because our work is bespoke to your property, and begins as soon as payment clears, you agree that we may start within that period and you acknowledge that you lose the right to cancel once the work is complete.
If you cancel after we have started but before delivery, we will refund the balance less a fair charge for work already carried out.
10. Complaints and dispute resolution
If something has gone wrong, contact us first at inquiries@tmdesignsltd.com. We will acknowledge within 5 working days and aim to resolve matters within 30 days.
If we cannot resolve it between us, both parties will consider mediation in good faith before starting court proceedings. Nothing in this clause prevents either party from applying to court, and it does not affect your statutory rights as a consumer.
11. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK, you may bring proceedings in your local courts.
12. General
If any provision is found unenforceable, the rest remain in force. These terms, together with the written quotation we issue you, form the entire agreement between us.
